Due to accident at work I am suing work Do I have to claim Industrial Accident Benefit?

I had an accident at work on nightshift and due to my works negligence and injury to me I have been off work for 10 months. I have a solicitor and he is taking my case to court of course work is contesting it. Meanwhile the DWPhave informed me that I have grounds to claim Industrial Accident Benefit or some such other grand title. If I am successful in court (which looks good) will any monies given to me by this benefit have to be repayed. If this is the case I would rather not be bothered by their invasive procedures. Seems they are keen on me to go for it and of course I am skeptical that they will want money that I have suffered for and too be quite honest trying to get SSP ES and lower rate DLA has been nothing short of a nightmare. Does anyone have an answer?
