My name is Richard Tillmon, and I have recently experienced a

Sheriff’s Office (M.C.S.O) deputies. My conduct throughout the
Entire ordeal was that of submission. I never resisted, and at no point
Throughout the assault did I display any behavior that would justify
The abuse I received. Injuries incurred, but were not limited to, broken
Ribs; head, neck and back trauma, and extensive psychological and
Emotional suffering. Upon personal review of the State of
Arizona
Constitution of Criminal Code (sub-sections 13-1204(A) 8, 13-1204(A) 11,
13-1204(A) 1, 13-1202.A., 31-127., and 13-1203.), it appears that an indictment
May be warranted on several counts of Aggravated Assault, and several
Misdemeanors. Fortunately, the whole incident of abuse was captured on
Maricopa
County’s surveillance video at the Fourth Avenue Jail.
During my incarceration, I made exhaustive attempts to rectify
The situation by filing the necessary inmate grievance forms. At this
Point all I sought was a proper investigation and reprimand for the
Excessive use of force by the officers. Had my concerns been addressed I
Would not be writing to you today. Should you decide to look into this?

Dear Sir or Madam:

Please be advised that pursuant to A.R.S. §12-821.01 et seq., we hereby serve this Notice of Claim on behalf of Richard Tillmon.

FACTUAL BACKGROUND

On or about May 29 2006 Richard Tillmon was in the Maricopa County Superior Court Initial Appearance court waiting for his case to be called. Mr. Tillmon yawned and made a slight noise. Mr. Tillmon had a broken jaw which made it hard for him to yawn thus the noise. An unknown sheriff deputy1 asked out loud, "who said that?" Mr. Tillmon acknowledged that it was him. The first unknown deputy then said, "Shut the up." Mr. Tillmon then stated that he wanted to be taken back to his cell. He stood up, walked toward the wall, put his head against the wall and put his hands behind his back. The first unknown deputy handcuffed Mr. Tillmon and pushed him through a side door. The side door led to an entryway where there was another door in order to exit. While being transported through the first door the first unknown deputy shoved Mr. Tillmon against the wall pressing his face against the wall with his hand on Mr. Tillmon’s broken jaw, slamming Mr. Tillmon’s head against the concrete wall. The first unknown deputy proceeded to knee Mr. Tillmon with his right leg on Mr. Tillmon’s lower right leg. The second unknown deputy then entered the entryway and pushed Mr. Tillmon down to the floor. There the officers stepped on his back and one officer put his knee on Mr. Tillmon’s jaw. The officers then picked up Mr. Tillmon and put another set of handcuffs on his forearms. The first unknown deputy then grabbed Mr. Tillmon by the arms, which were now double handcuffed, and pushed him; head first, against the door. The first and second unknown deputy then rammed Mr. Tillmon’s head against the outside wall.

As a result of these injuries, Mr. Tillmon suffered a broken rib and a chest wall injury. Some fillings fell out of his teeth and a concussion due to this incident. Mr. Tillmon has scars throughout his arms.

Mr. Tillmon suffers from severe migraine headaches, soft tissue injury, eye injury and blurry vision, hearing loss, upper and lower back pain, elbow and shoulder pain. He now has circulation problems in both his hands and his left hand has no feeling in it. He cannot sleep at night. He is unable to concentrate and has memory loss. Due to the rib injury Mr. Tillmon has trouble breathing and feels that his chest is caving in periodically.

In addition to the above, Richard Tillmon has suffered from emotional distress, and has had his quality of life, and everyday activities changed for the worse.

CLAIMS

The claim against the two unknown deputies/assaulters, Maricopa County Sheriff’s Office, Joe Arpaio, is made in both his individual and official capacity as the Sheriff of Maricopa County, Arizona.

The claims against the assaulters of Richard Tillmon; are made on each of them individually and in their official capacity as employees of the Maricopa County Sheriff’s Office. This claim is predicated on Richard Tillmon’s rights to receive compensation for his claim involving personal injury including false imprisonment, assault, battery, intentional infliction of emotional distress, negligent infliction of emotional distress, and general negligence.

The claim against Sgt.Cinquinz and other investigators of this event for the Maricopa County Sheriff’s office is made on them individually and in their official capacity as employees of the Maricopa County Sheriff’s Office. This claim is predicated on Richard Tillmon’s rights to receive compensation for his claim involving personal injury, false imprisonment, assault, battery, intentional infliction of emotional distress, negligent infliction of emotional distress, general negligence, and an effort by the Maricopa County Sheriff’s office and its officers and agents to cover up this event.

This claim is also brought pursuant to 42 U.S. Code § 1983 and 1985 for the repeated violation of Richard Tillmon’s Constitutional Rights by deputies of the Maricopa County Sherriff’s Office including the violation of Mr. Tillmon’s 4th, 5th, 6th, 8th and 14th Amendment rights.

Demand is made that the Maricopa County Sheriff’s Office produces all video tapes relating to the above referenced assault as well as the identities of the assaulting deputies.

This claim may be settled for not less than ,500, 000.00.
